New Hampshire's Supreme Court has upheld the first-degree murder conviction of a man who was sentenced to life imprisonment in the death of an 11-month-old boy in 2015.
In anopinion issued Tuesday, the court rejected Tommy Page's appeal that a judge was wrong to deny motions to suppress photos on Page's cellphone and allow statements by the boy's mother that she didn't want to be alone with her son because she was having "bad thoughts." The court also rejected an argument that the judge failed to instruct the jury properly.
Authorities say the mother left her son, Shawn Sylvester, of Alexandria, with Page, her boyfriend, for a few hours. She returned to find Shawn "lying face-down in his bed in a pool of vomit." Authorities said he died of blunt impact head trauma.
