The N.H. Attorney General’s office will not file charges against Rep. David Campbell (D-Nashua) for who running down five ducks in a hotel parking lot in December, or the former Nashua Police Commissioner Thomas Pappas who drove Campbell from the scene.
The finding, which was detailed in a 14-page report, comes a day after David Campbell announced he won’t seek reelection, and almost 3 months after Thomas Pappas resigned over the incident.
Beyond the lack of charges, the reports bottom line is that prosecutors believe that Campbell – who declined to be interviewed for the report -- and Pappas -- who did talk to investigators -- hold to versions events that night are “simply not credible.”
Among other things, the report found David Campbell mislead police when he told them that Pappas drove him home from the Crowne Plaza parking lot. Pappas instead dropped Campbell at the apartment of what the report calls a “lady friend.”
That report also challenged Campbell’s claim that he was unable to receive phone calls when police might have tried to reach him because his phone battery had died.
Instead, the report says Campbell was using his phone doing that time period, and that he left a message on Pappas's cell phone suggesting he was someplace else – a move the report called “an attempt to suggest an alternative version of the events after Campbell killed the ducks.
The report concludes by noting, the AG did consider charging Campbell and Pappas with crimes, official but decided not to because they lacked evidence to prove charges beyond a reasonable doubt.
