N.H. Biomass Plants Pull State Court Case After FERC Rejects Subsidy Plan

A group of New Hampshire biomass power plants say they're dropping a state Supreme Court challenge over an embattled subsidy plan.

It comes after federal regulators ruled the subsidies were invalid under national energy law.

The wood-fired power plants had wanted state regulators to enforce the subsidies while that federal challenge was ongoing.

Now, they say they it's not practical to keep pursuing the case.

The decision marks another defeat for New Hampshire's biomass industry, where small facilities have struggled to remain profitable.

State legislators upheld the governor's veto of another subsidy plan this year.

Some of the six affected plants are idle as the sector considers its next steps.
