Judge Denies Request To Release Gun Used In Pamela Smart Murder Case

The gun used to kill Pamela Smart’s husband 25 years ago will remain in the state’s hands, after a judge denied a request to release the murder weapon.

The Union Leader reports the owner of the firearm, Vance Lattime Sr., had requested the gun be returned to him.

His son, Vance Lattime Jr., was paroled in 2005 after serving 15 years for his role as an accomplice in the 1990 murder of Gregory Smart.

But Judge Andrew Schulman sided with state prosecutors, who argued they need to keep the weapon as evidence should Pamela Smart try to get out of her conviction in the death of her husband.

Pamela Smart is serving a life sentence without parole for her role in her husband's murder.
