Defendants in a case over school funding in New Hampshire want the state Supreme Court to take up their case.
The Attorney General's office filed an appeal Wednesday with the Supreme Court on behalf of the state, Governor Chris Sununu, the New Hampshire Department of Education and Education Commissioner Frank Edelblut.
It asks the Supreme Court to reverse a decision issued in June by the Superior Court in Keene, which said the state must do more to meet its duties to fund a constitutionally adequate education.
The case was brought by the Contoocook Valley school district and three nearby school districts in southwestern New Hampshire.
The state says the lower court's ruling is flawed because it equates the districts' current spending on some district costs with the real cost of an “adequate” education, and assumes the state should cover that.
In the past, the Supreme Court has sided with school districts over funding questions but no major education funding case has come before the current group of judges.
